SAN FRANCISCO (MarketWatch) â" Both sides are displeased with the $1 billion verdict awarded Apple Inc. in its patent feud with Samsung Electronics Co. and are set to ask a federal judge at a Dec. 6 hearing to modify the juryâs finding.

In legal papers filed Friday and Saturday, Samsung is reportedly calling on U.S. District Judge Lucy Koh of San Jose to amend or toss out the juryâs Aug. 24 ruling that found its products infringed on Apple /quotes/zigman/68270/quotes/nls/aapl AAPL +0.20% technology used in its iPhones and iPads.

The legal wrangling between Apple and Samsung KR:005935 +1.20% , the global leader in smartphone sales, continued as stores around the U.S. on Sunday entered a third day of selling Appleâs new iPhone 5, which debuted Friday in retail outlets.
At a fairly crowded Apple store in Bethesda, Md., prospective buyers were playing with the new, lighter device on a Sunday morning.
One salesman was trying to convince a reluctant couple of the merits of the newest phone as opposed to the iPhone 4s. The poorly reviewed map service also was a topic of conversation.

The store was filled with activity, but not all of it centered on the iPhone 5 â" plenty of iPads and Macs were also being tested.
While Apple hasnât released sales figures, it did say there were more than 2 million pre-orders in the first 24 hours for the smartphone, with demand exceeding supply and the backlog stretching into October.
Across the U.S., many stores reported selling out of the new phones on Saturday, Associated Press reported.
A Verizon store in New York City said the 32 and 64 gigabyte models, but not the 16 GB version, were available, AP said, adding that A Sprint store in a suburb of St. Paul, Minn., said all but the most expensive 64 GB iPhone 5s were sold out.
